Welcome to KubiQo. These Terms of Service (“Terms”) govern your access to and use of our platform and services. By using our services, you agree to be bound by these Terms.
If you do not agree with these Terms, do not use our platform.
Who We Are
KubiQo is a managed European cloud platform operated by Greater B.V., located in the European Union. We provide businesses with cloud infrastructure based on SUSE tooling and hosted in Switzerland by Exoscale.
Eligibility
By using KubiQo, you confirm that:
- You are acting on behalf of a company or organization.
- You have the authority to enter into these Terms on behalf of that entity.
- You are not located in a jurisdiction where use of our services would violate local laws or export restrictions.
Services Provided
KubiQo provides:
- Access to a managed infrastructure stack based on open-source European technologies
- Hosting via Exoscale data centers in Switzerland
- Technical support, resource scaling, monitoring, and platform updates
We may update or modify our services from time to time to improve performance, security, or compliance.
Customer Responsibilities
You agree to:
- Use the platform in accordance with all applicable laws and regulations
- Not use the services to host or transmit illegal content
- Maintain the confidentiality of your login credentials
- Inform us immediately of any unauthorized use or security breach
Acceptable Use Policy
You may not use our services to:
- Violate the rights of others, including intellectual property and privacy rights
- Send spam or malicious software
- Interfere with the integrity or performance of the platform
- Attempt unauthorized access to any systems or accounts
Violations may result in suspension or termination of your access without notice.
Payment & Billing
Use of KubiQo is subject to agreed-upon pricing plans.
You agree to pay all applicable fees as specified in your service agreement or invoice.
Late payments may result in service suspension. All fees are exclusive of VAT or applicable taxes unless stated otherwise.
Data Ownership & Privacy
All data you host on KubiQo remains your property.
We do not access or use your data except to deliver and maintain the service.
We process personal data in accordance with our Privacy Policy and applicable EU privacy laws, including the GDPR.
Service Availability
We aim to provide high availability but do not guarantee 100% uptime.
Planned maintenance or emergency updates may result in brief service interruptions, which we will communicate where possible.
We are not liable for downtime or data loss beyond what is explicitly covered in your service-level agreement (SLA), if applicable.
Intellectual Property
All KubiQo branding, website content, and proprietary service components are the intellectual property of Greater B.V. or its licensors.
You may not copy, modify, reverse-engineer, or distribute any part of the platform unless permitted by law or with written consent.
Termination
You may terminate your agreement with KubiQo by providing written notice.
We reserve the right to suspend or terminate access if you breach these Terms or pose a security or legal risk.
Upon termination, your access will be revoked and your data may be deleted after a retention period.
Limitation of Liability
To the extent permitted by law, KubiQo and Greater B.V. shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or business opportunities
- Any damages exceeding the amount paid by you in the past 12 months
Governing Law
These Terms are governed by the laws of the Netherlands.
Any disputes shall be resolved by the competent courts in Amsterdam, unless otherwise agreed.
Changes to These Terms
We may update these Terms from time to time.
You will be notified of significant changes via email or the platform. Continued use of the service constitutes acceptance of the updated Terms.
